These Terms & Conditions (“Terms”) govern your use of the website at e3energy.com.au (the “Site”) and any quote, sale, supply or installation of products and services provided by E Cubic Pty Ltd (ABN 83 693 352 055), trading as E3 Energy (“we”, “us”, “our”). By using the Site, submitting an enquiry, accepting a quote, or engaging us for installation, you (“you”, “the Customer”) agree to be bound by these Terms.

1. About us

E3 Energy designs, supplies and installs solar and battery energy storage systems for residential and commercial customers across Australia, using equipment from manufacturers including Sigenergy, FOX ESS and JA Solar.

2. Use of the website

The Site, including its content, calculators (such as the Savings Calculator), text, graphics, logos and product information, is provided for general information purposes only. Indicative system sizes, savings estimates and scenarios shown on the Site are illustrative only and are not a quote, guarantee, or substitute for a site-specific assessment of your bills, usage data, roof and tariff. You must not misuse the Site, attempt to gain unauthorised access to it, or use it in a way that breaches any applicable law.

3. Quotes

Quotes provided by E3 Energy, whether generated through the website, in person, or by phone or email, are based on the information available to us at the time (including your electricity bills, usage data, site photos or measurements, and any information you provide). Quotes are estimates and may change following a site inspection, technical assessment, or if site conditions differ from what was described. Unless stated otherwise, quotes are valid for the period stated on the quote document and do not constitute a binding contract until formally accepted in writing (including electronic acceptance) by both parties.

4. Orders and acceptance

A binding agreement for the supply and/or installation of a system is formed only when we issue a formal contract, invoice or order confirmation and you accept it (including by signature, electronic acceptance, or payment of a deposit). These Terms, together with that contract or order confirmation, form the entire agreement between us in relation to that order, unless we expressly agree otherwise in writing.

5. Pricing and payment

  • All prices are in Australian dollars and, unless stated otherwise, include GST.
  • A deposit may be required to confirm an order, with the balance payable on terms set out in your contract or invoice (commonly on completion of installation or commissioning).
  • Prices may be subject to change prior to formal order confirmation, including due to changes in supplier costs, government rebates, or site-specific requirements identified after a technical assessment.
  • Where a quote is based on eligibility for a government rebate or incentive, the final price payable by you may increase if that eligibility changes or is not approved — see our [Rebate Disclaimer] for further detail.

6. Site assessment, access and conditions

You must provide accurate information about your property, switchboard, roof, and electricity usage to enable an accurate quote and safe installation. You must provide safe and reasonable access to the site for assessment and installation, and ensure the site (including roof structure, switchboard and wiring) is suitable for the proposed system. If, after a technical or site assessment, we determine that additional work is required (for example switchboard upgrades, electrical remediation, or roof works) to safely install the system, we will advise you before proceeding, and this may affect price and timing.

7. Installation and timing

We will use reasonable efforts to install your system within the timeframe agreed at the time of order. Installation timing may be affected by matters outside our reasonable control, including weather, supplier or shipping delays, distributor or network approvals, council or building requirements, and the availability of accredited installers. We will keep you informed of any expected delay.

8. Product warranties

Products we supply (including batteries, inverters and panels) are covered by the relevant manufacturer’s warranty (for example Sigenergy, FOX ESS or JA Solar), the terms of which are provided to you at the time of installation or on request. Installation workmanship is covered by the workmanship warranty stated in your contract or invoice. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

9. Cancellations, changes and cooling-off

Where applicable under the Australian Consumer Law or relevant State or Territory legislation (including unsolicited consumer agreement requirements), you may be entitled to a cooling-off period after entering into a contract with us — details will be set out in your specific contract. Cancellation after the cooling-off period, or after work or procurement has commenced, may incur costs already reasonably incurred by us (for example custom equipment ordered, design work completed, or site works carried out), which will be set out in your contract.

10. Limitation of liability

To the maximum extent permitted by law, and subject to any consumer guarantees that cannot be excluded under the Australian Consumer Law, our liability to you for any loss or damage arising from the products or services we supply is limited, at our option, to resupplying the services, repairing or replacing the goods, or paying the cost of doing so. We are not liable for indirect, consequential or special loss (including loss of revenue, loss of energy savings beyond what is expressly warranted, or business interruption) except where the law prevents such exclusion.

11. Savings and performance estimates

Any savings figures, payback periods, “indicative scenarios” or performance estimates shown on the Site or in a quote are estimates only, based on information available at the time (including your bills, tariff and usage pattern) and on assumptions about future electricity prices, tariffs, weather and usage that may not eventuate. They are not a guarantee of actual savings or performance.

12. Intellectual property

All content on the Site, including text, graphics, logos and the E3 Energy name and branding, is owned by or licensed to E Cubic Pty Ltd and is protected by copyright and other intellectual property laws. You may not reproduce, distribute or commercially exploit any part of the Site without our prior written consent.

13. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria in relation to any dispute arising from these Terms.

14. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on our website, with the “Last updated” date revised accordingly. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
